Terms of Service

These Terms set out the conditions for providing MojiCare (the "Service") and the rights and obligations between us and the user regarding use of the Service. By using the Service, the user agrees to these Terms.

1. Scope

These Terms apply to all matters relating to use of the Service.

Individual rules and guidelines we post within the Service form part of these Terms. Where they conflict, the individual rules take precedence.

2. Accounts and API keys

The user is responsible for keeping API keys secure. Sharing, reselling, or lending API keys to third parties is prohibited.

Use API keys on the server side only. Embedding an API key in a browser, mobile app, or any client where a third party could obtain it is prohibited.

We are not liable for damages arising from leaked API keys.

3. Fees and usage measurement

Fees are as set out on the pricing page. All listed prices exclude tax (consumption tax is added separately).

The usage that is subject to metered billing is measured by our gateway count, which is authoritative.

Because of caching used for performance, limit checks may be off by a few requests. Please understand this in advance.

Requests that fail due to upstream errors (server errors) are, in principle, not billed.

4. Plan changes, cancellation, and suspension

Plan upgrades apply immediately; downgrades and cancellations apply from the next renewal date.

After cancellation, you may keep using the plan until the next renewal date. We do not provide prorated refunds.

If the user breaches these Terms, we may suspend the account or revoke API keys without prior notice.

5. Dictionary and results

The dictionary used for moderation may be updated without notice to improve quality. Updates take effect immediately for all users.

We do not guarantee the completeness or accuracy of moderation results. The user is responsible for the final decision on whether to publish content.

6. Service quality

We strive to provide the Service reliably, but we offer no guarantee such as an uptime SLA (it is a best-effort goal).

We may temporarily suspend all or part of the Service for maintenance or incident response.

7. Prohibited conduct

Conduct that violates laws or public order, infringes the rights of us or third parties, or interferes with operation of the Service is prohibited.

Reverse engineering the Service, placing excessive load on it, and sharing or reselling API keys are prohibited.

8. Disclaimer and limitation of liability

Except in cases of our willful misconduct or gross negligence, we are not liable for damages incurred by the user in connection with the Service.

Even where we are liable, the amount of compensation is capped at the fees the user paid us in the month the event occurred.

9. Changes to these Terms

We may change these Terms with notice to users where we deem it necessary. The revised Terms take effect when posted within the Service.

10. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to the Service is subject to the exclusive jurisdiction of the court that has jurisdiction over our location as the court of first instance.
